USPA NEWS - German prosecutor requested Tuesday to the Court that must decide about the extradition of the former regional Prime Minister of Catalonia, Carles Puigdemont, his delivery to Spain for crimes as rebellion and misappropriation of public money, and asked that must continue in prison until his delivery to the Spanish authorities to consider that there risk of escape.
German prosecutor of the federal state of Schleswig-Holstein (Northern Germany) has admitted the accusations against the former Catalan president included in the extradition request issued by the Spanish Supreme Court judge Pablo Llarena. Now, it will be the territorial Court of that state, in which Puigdemont was arrested and imprisoned last March 25, 2018, who decides on the extradition of the Spanish politician. For this purpose, the Court has a period of 60 days renewable for another 30 days.
“The accusation of rebellion contemplates, essentially, the holding of an unconstitutional referendum despite the fact that violent confrontations were to be expected," explains the Prosecutor's Office in its brief, in which it considers that the crime of rebellion imputed by Judge Llarena may be equivalent to German crime of high treason. "A literal coincidence of the German and Spanish precepts is not legally required," argues the prosecutor in relation to the need to register acts of violence, required by German laws but not by Spanish laws.
The German Prosecutor also recalls that Puigdemont committed the Catalan Police ordering him to defend the supporters of the referendum and stresses that the crime of misappropriation of public funds corresponds exactly to that included in the German Criminal Code. In this way, the German Prosecutor's Office assumes the literal nature of the extradition request presented by the Spanish Supreme Court. To ensure the delivery to the Spanish authorities of the former Catalan president, the Prosecutor requests that Puigdemont remain in jail, since, in his opinion, there is a certain risk of escape.
